Employee Gets Sh598,000 After Being Fired Over Sexual Harassment By M.D

In a recent article dubbed Revealed! My Confessions as an Unpaid Intern With A Kenyan Leading Media Station which was posted here on Career Point Kenya, the author writes that, “It was just so crazy having old men ‘hit on you’ all the time. What’s funnier was the fact that most were old enough to be your dad, heck even your grandpa. And should you resist (like I always did) you’d automatically be termed ‘kichwa ngumu’(hard headed).”

Sexual harassment it seems still thrives in the workplace. Daily Nation today reports of how Mr Johnson Kithedu the Managing Director of Milango Financial Services was fined Sh598,000 after he was found guilty of sexually harassing Ms Mercy Mbuchu which is something contrary to the Employment Act Section 6.

Ms Mbuchu is said to have been dismissed after refusing to give in to the sexual advances by the M.D. It’s reported that Mr Kithedu hugged her several times and went ahead to invite her to his house, an offer which she refused.

But not the kind to give up, the M.D later hosted her for lunch on Moi Avenue in Mombasa and promised to take care of her.

She also revealed that she was also fired because she refused to buy shares like the other employees had done.

The judge presiding over the case is quoted by Daily Nation saying, “The persistent hugging, was a behavior of sexual nature which was not only unwelcome to the claimant but to which also had a detrimental effect on her employment , job performance and satisfaction.”

Mr Mbuchuwill receive Sh60,000 as her month’s salary in lieu of notice and Sh38,000 for the 19 days she worked in June.
